The Fish and Wildlife Service says most projects here fall under residential construction or clearing land. On a wooded lot, the approvals come before the machines. Do you need a permit to clear a lot in Boiling Spring Lakes?

The city's rules start with the trees. Its tree permit is required before any tree larger than 7.9 inches DBH comes down. DBH means diameter at breast height. Any pine also needs U.S. Fish and Wildlife Service authorization. The city will not issue a permit for pines until that authorization is submitted. The property owner applies for both before land clearing begins. The city's application is on its website, under Forms and Permits. The Fish and Wildlife review runs through the Service's online IPaC tool.

That review looks at the project area plus 200 feet around its edges. The Service says RCW nests need little to no disturbance within 200 feet of cavity trees. The package needs a site plan marking the trees and which ones come out. It also gives the DBH of each pine to be cut. The Service recommends an RCW survey by a qualified consultant, though surveys are not required. It says surveys work best when the leaves are off, especially in January, February and March.

Driveways, culverts and drainage on a Boiling Spring Lakes lot

Next come the driveway and drainage rules. City code says no private driveway or culvert goes in without a permit from the city stormwater department. The property owner signs the application, with a drawing of the drive and culvert. The city sets the culvert type, diameter and length. Open pipe ends must be stabilized with rip-rap. Public Works signs off the driveway before a certificate of occupancy issues. We set driveway culverts to the city's size, with rip-rap at the open ends.

A new single-family home on a standalone lot also needs a lot drainage plan. It goes in with the building permit. City code says the plan shows graded swales, culverts and ditches. It also calls for silt fence and a washed stone construction entrance over fabric. We build those items as part of site prep. When land disturbance covers more than one acre, NCDEQ requires an erosion and sedimentation control plan. It goes in at least 30 days before work starts.
